Aboriginal and Torres Strait Islander Elected Body Amendment Bill 2017

This bill will amend the Aboriginal Torres Strait Islander Elected Body Act 2008 to strengthen the functions of the Aboriginal and Torres Strait Islander Elected Body to consult and provide advice on systemic or whole-of-government issues. The delineation of responsibility between the Elected Body and the ACT Government in the management of operational aspects of Aboriginal and Torres Strait Islander policy and service provisions will also be clarified by the amendments. The bill will make amendments in relation to community forums and harmonise the Act with the Heritage Act 2004.

Aboriginal and Torres Strait Islander Elected Body Amendment Bill 2020

Presented by Ms Stephen-Smith (Minister for Aboriginal and Torres Strait Islander Affairs)—20 February 2020

This bill will amend the Aboriginal Torres Strait Islander Elected Body Act 2008 to enable broadcasting of the public hearings of the Aboriginal and Torres Strait Islander Elected Body (ATSIEB). The bill also imposes timeframes on both the ATSIEB and the Government in relation to the presentation of reports and Government responses to those reports. Amendments to the Act will also include imposing a ‘caretaker period’ in the lead-up to an ATSIEB election. The bill also recognises the ability for the ATSIEB to provide advice to ministers about the views of the Aboriginal and Torres Strait Islander community.

ACT Teacher Quality Institute Amendment Bill 2019

Presented by Ms Berry (Minister for Education and Early Childhood Development)—6 June 2019

This bill will amend the ACT Teacher Quality Institute Act 2010 and the ACT Teacher Quality Institute Regulation 2010. The amendments will ensure the quality of the ACT’s teacher workforce and build a workforce that meets the needs of ACT school children into the future. The amendments include, requiring pre-service teachers to apply for approval with the ACT Teacher Quality Institute to undertake professional experience in a school in the ACT during pre-service teacher education, authorising the Institute to provide pre-service teacher information to principals and universities and authorising the Institute to collect data about the current workforce profile of teachers to inform teacher workforce planning.

Adoption Amendment Bill 2020

This bill will amend the Adoption Act 1993 by changing the current provisions that are used by the Court when considering whether to dispense with the requirement for parental consent for an adoption and by including provisions to place the best interests of the child or young person at the centre of decision-making about dispensing with parental consent. The bill will also change the residency requirement that is currently set out in the Act for adoption orders that relate to an adult prospective adoptee.

Animal Diseases Amendment Bill 2018

This bill will make a number of amendments to the Animal Diseases Act 2005 and the Animal Diseases Regulation 2006. This bill will extend the use of the National Livestock Identification System to include owners of cattle, sheep, goats and pigs, which will improve biosecurity in the ACT.

Animal Welfare Legislation Amendment Bill 2019

This bill will amend a number of Territory laws relating to animal management and welfare in the Territory to strengthen the legislation and improve the quality of life for animals.

Anti-corruption and Integrity Commission Bill 2018

The purpose of this bill is to establish an ACT-specific integrity body, the Anti-corruption and Integrity Commission (the Commission). The Commission’s functions will be to investigate corruption issues, matters referred to the Commission by the Legislative Assembly, and matters involving serious or systemic corruption.

Betting Operations Tax Bill 2018

This bill establishes a new tax that will be payable by betting operators that accept bets from, or provide services to, people located in the ACT, regardless of where the operator may be based. This bill will amend the Taxation Administration Act 1999 so that the general tax administration and enforcement provisions of that Act will apply.

Births, Deaths and Marriages Registration Amendment Bill 2018

This bill will amend the Births, Deaths and Marriages Registration Act 1997 and the Births, Deaths and Marriages Registration Regulation 1998 to provide birth parents the right to choose whether to register a fetus as a stillborn child where it showed no sign of heartbeat before reaching 20 weeks’ gestation but was born during or after 20 weeks’ gestation.

Births, Deaths and Marriages Registration Amendment Bill 2020

This bill will amend the Births, Deaths and Marriages Registration Act 1997 by removing certain barriers for trans, intersex and gender diverse young people when changing their given name or particulars about gender identity to better reflect their gender identities and enable the obtaining of an updated birth certificate or a recognised details certificate. The bill also introduces provisions to allow the Registrar-General to issue integrated birth certificates to enable individuals, who were born in the ACT and adopted, to apply for a birth certificate that includes the details of both birth parents and adoptive parents. Provisions in the bill will also permit, in some situations, for the issuing of integrated birth certificates where a person born overseas is adopted in the ACT.

Births, Deaths and Marriages Registration (Tissue Donor Acknowledgment) Amendment Bill 2020

This bill will amend the Births, Deaths and Marriages Registration Act 1997 to provide opportunities for families of a person who has donated tissue, while living or on death, to have the donation formally acknowledged.

Building and Construction Legislation Amendment Bill 2017

Presented by Mr Gentleman (Minister for Planning and Land Management)—30 November 2017

This bill will amend the Construction Occupations (Licensing) Act 2004 by expanding the information sharing provisions about public safety to non-Territory agencies. The bill also amends the Electricity Safety Act 9171 and the Electricity Safety Regulation 2004 to create a concept of the electrical wiring rules which provides for incorporating provisions and requirements not included in the relevant Australian and New Zealand standard.

Building and Construction Legislation Amendment Bill 2019

This bill amends a number of Territory laws to improve and refine the operation of the laws. The amendments will ensure public protections in the laws operate effectively and people involved in construction licences are accountable for work associated with their licence. The bill will also implement provisions that relate to the ACT Government’s Improving the ACT Building Regulatory System reform program and a National Review of Security of Payment Laws.

Building and Construction Legislation Amendment Bill 2020

This bill will amend the Building Act 2004, the Building (General) Regulation 2008 and the Construction Occupations (Licensing) Act 2001 by implementing provisions relating to the ACT Building Regulatory System reform program. The bill also introduces a new administrative power for the responsible Minister for the functions of the Construction Occupations Registrar to make a statement of expectations in relation to the Registrar’s functions. A number of minor and technical amendments to building laws will also be made by this bill.

Canberra Institute of Technology Amendment Bill 2018

This bill will amend the Canberra Institute of Technology Act 1987 by substituting references to “institute” with CIT and to align language in the Act to better reflect CIT’s established policies. The amendments will also reduce the minimum number of board members, discontinue ACT Government board member appointments and revise board membership eligibility criteria.

Casino and Other Gaming Legislation Amendment Bill 2018

This bill will amend a number of Territory laws to create a high level of transparency in decisions relating to the Casino including the establishment of a Casino Advisory Panel, a new regulation to set out requirements for social impact assessments, and a new gaming machine licence condition to ensure harm minimisation measures applicable to casino gaming machines cannot be circumvented.

Casino (Electronic Gaming) Bill 2017

Presented by Mr Ramsay (Attorney-General)—24 August 2017

This bill will establish a regulatory framework for the introduction of electronic gaming products in the casino, subject to redevelopment occurring. Requirements for the casino includes undertaking a Social Impact Assessment before being issued a gaming machine authorisation certificate, forfeiting one in every three gaming machines acquired and limits the number of machines to 200 and Fully Automated Table Games (FATG) to 60.

Cemeteries and Crematoria Bill 2019

This bill will provide a financially sustainable model for management of cemeteries and crematoria that recognises, and provides for, the diverse needs of the community by; recognising the rights of people to dignified and respectful treatment of their human remains and the remains of their loved ones; respecting diverse burial, cremation and internment practices, cultural practices and religious beliefs of people; and promoting financially sustainable facilities and practices for burying and cremating human remains. The bill will also create a framework to ensure that community needs and preferences in particular religious and cultural needs, can be met.

Children and Young People Amendment Bill 2018

Presented by Ms Stephen-Smith (Minister for Disability, Children and Youth)—10 May 2018

This bill will amend the Children and Young People Act 2008 to clarify requirements for commencing a care and protection appraisal for matters involving allegations of abuse or neglect of a child. This bill will also consolidate responsible person delegations and enable sub-delegation within an approved care and protection organisation. A number of technical and consequential amendments to the Act will also be made by this bill.

City Renewal Authority and Suburban Land Agency Bill 2017

This bill will establish a City Renewal Authority and a Suburban Land Agency and outline the role and responsibilities of each entity. The bill will also make consequential amendments to a number of ACT laws as a result of the establishment of the entities.

Civil Law (Wrongs) (Child Abuse Claims Against Unincorporated Bodies) Amendment Bill 2018

This bill will amend the Civil Law (Wrongs) Act 2002 to implement recommendation 94 of the Royal Commission into Institutional Responses to Child Sexual Abuse in its Report on Redress and Civil Litigation. This bill will enable an unincorporated body to nominate an entity to act as the defendant in a proceeding for a child abuse claim, allow a court to make an order to appoint a related trust as a defendant to a child abuse claim and allow trustees to apply trust property to meet liability for child abuse.

Climate Change and Greenhouse Gas Reduction (Principal Target) Amendment Bill 2018

This bill will amend the Climate Change and Greenhouse Gas Reduction Act 2010 to bring forward the principal target date for achieving net zero emissions from 30 June 2050 to 30 June 2045.

Climate Change and Greenhouse Gas Reduction (Renewable Electricity Target) Amendment Bill 2019

This bill will amend the Climate Change and Greenhouse Gas Reduction Act 2010 to enable an ongoing 100 percent renewable electricity target post-2020. The bill also allows the Minister to provide a clear summary of progress against the renewable energy targets in the Minister’s annual report.

Commercial Arbitration Bill 2016

This bill will repeal the Commercial Arbitration Act 1986 and replace it with legislation that provides for fair and final resolution of commercial disputes by impartial tribunals without unnecessary delay or expense.

Confiscation of Criminal Assets (Unexplained Wealth) Amendment Bill 2020

Presented by Mr Ramsay (Attorney-General)—20 February 2020

This bill will amend the Confiscation of Criminal Assets Act 2003 to allow for the restraint and, ultimately, the forfeiture of property by a person connected to a serious criminal offence, where that person cannot show their wealth was acquired lawfully. The unexplained wealth scheme created by this bill will provide for two types of orders, unexplained wealth restraining orders and unexplained wealth orders.

Consumer Protection Legislation Amendment Bill 2018

This bill will amend the Eggs (Labelling and Sale) Act 2001, the Fair Trading (Fuel Prices) Act 1993 and the Animal Welfare Act 1992 by improving consumer protection to ensure consumers are provided clear and accurate information when purchasing free-range eggs and fuel. The bill will also update the Territory’s regulation of free-range eggs and create the new Eggs (Labelling and Sale) Regulation 2018.Changes to the Territory’s regulation of the display of fuel price boards are also included in the bill.

Controlled Sports Bill 2018

This bill will establish a legislative framework to update regulations on combat sports events operating in the ACT. The bill will improve safety for contestants and promote integrity and replace the Boxing Control Act 1993.

Co-operatives National Law (ACT) Bill 2017

Presented by Mr Rattenbury (Minister for Justice, Consumer Affairs and Road Safety)—16 February 2017

This bill will repeal the Cooperatives Act 2002 and replace it with a uniform national law in relation to co-operatives. The new legislation includes mutual recognition provisions, clarifies governance provisions and reduces reporting provision for smaller co-operatives.

Coroners Amendment Bill 2020

Presented by Mr Ramsay (Attorney-General)—13 February 2020

This bill will amend the Coroners Act 1997 by including provisions to better meet the needs of families who find themselves within a coronial process. The bill also amends the Act by making it easier for the Coroners Court to implement restorative approaches in its daily practice.

Courts and Other Justice Legislation Amendment Bill 2018

This bill will amend a number of ACT statutes by facilitating access to justice by introducing efficiency measures to reduce time required and red tape for people involved in litigation. The bill will introduce measures to assist courts to better administer their procedures and cases to ensure fair outcomes and will also introduce changes to how oaths and affirmations are administered.

Courts and Other Justice Legislation Amendment Bill 2018 (No 2)

This bill will amend the ACT Civil and Administrative Tribunal Act 2008, Court Procedures Act 2004, Director of Public Prosecutions Act 1990, Magistrates Court Act 1930,and Supreme Court Act 1933. The bill’s primary set of amendments will increase the retirement age of Magistrates, the ACAT President, and the Director of Public Prosecutions from 65 to 70.

Courts (Fair Work and Work Safety) Legislation Amendment Bill 2019

This bill will amend a number of Territory laws to support the instigation and conduct of fair work proceedings in the Magistrates Court and facilitate the trial of corporations for industrial manslaughter under the Work Health and Safety Act 2011.

This bill will introduce changes to the Territory’s legislative framework to enable the Government and the community to deal with the current COVID-19 public health emergency and will also give urgent effect to Commonwealth agreements.

This bill will make amendments to a number of Territory laws to enable the implementation of further responses to the current COVID-19 pandemic as well as the implementation of strategies to prevent further spread of COVID-19.

COVID-19 Emergency Response Legislation Amendment Bill 2020 (No 2)

Presented by Mr Ramsay (Attorney-General)—18 June 2020

This bill will amend the Electoral Act 1992 to support the conduct of a safe, fair and inclusive 2020 ACT election. The bill will expand the eligibility criteria for pre-poll voters, support the Electoral Commission’s deployment of an overseas electronic voting solution and support the Commission’s deployment of a telephone voting system for eligible ACT electors who are blind and vision impaired or have a physical disability. The bill will also repeal a section of the Supreme Court Act 1933 relating to the conduct of jury trials which was inserted into the Act during the COVID-19 pandemic.

Crimes (Anti-Consorting) Amendment Bill 2019

This bill will amend the Crimes Act 1900 to prevent consorting between defined persons. The bill will affect consorting with persons already convicted of criminal behaviour, apply once an official warning has been issued, and apply outside legitimate purposes for a limited time.

This bill will amend the Crimes Act 1900 to clarify the law of consent in sexual offences, intimate image abuse offences and child sex offences to provide improved outcomes for victims and the community.

Crimes (Disrupting Criminal Gangs) Legislation Amendment Bill 2019

This bill amends a number of Territory laws to introduce a range of measure to improve public order and safety, including; introducing new tiered offences of serious affray; amending the penalties for offences of fighting and offensive behaviours; and increasing maximum penalties for specified offences committed in connection with a criminal group or committed by a person associated with a criminal group.

Crimes (Offences Against Vulnerable People) Legislation Amendment Bill 2020

This bill will amend the Crimes Act 1900 and the Crimes (Sentencing) Act 2005 to define the definition of vulnerable person. The bill also creates three new offences intended to protect vulnerable people from abuse and creates a new sentencing consideration for the courts.

Crimes (Police Powers and Firearms Offence) Amendment Bill 2017

This bill will amend the Crimes Act 1900 to provide a specific offence to capture the conduct of drive-by shooting. Provisions in the bill will also provide police with statutory power to establish and control a crime scene.

Crimes (Protection of Police, Firefighters and Paramedics) Amendment Bill 2019

This bill will amend the Crimes Act 1900 to create new offences for assaults against police officers, firefighters and paramedics; intentionally or recklessly driving at a police officer and exposing a police officer to a risk to safety; and driving at and causing damage to a police vehicle.

Crimes (Restorative Justice) Amendment Bill 2018

This bill will amend the Crimes (Restorative Justice) Act 2004 to improve access to restorative justice in the ACT which will provide a greater capacity for victims of crime to navigate the criminal justice system.

Crimes Legislation Amendment Bill 2016

This bill will amend a number of Territory laws to improve ACT Policing’s ability to manage the Child Sex Offenders register. The amendments will also address a number of technical issues with robbery and burglary prosecutions and clarify rules for licensed firearms dealers.

Crimes Legislation Amendment Bill 2017

This bill will amend the Crimes (Sentence Administration) Act 2005 and the Crimes (Sentencing) Act 2005 to retrospectively delegate certain Director-General functions to ACT Corrective Services officers who have responsibility for the supervision of an offender on an Intensive Correction Order.

Crimes Legislation Amendment Bill 2017 (No 2)

This bill will amend a number of the Territory’s criminal laws to implement recommendations made by the Royal Commission into Institutional Responses to Child Sexual Abuse. The bill will also allow circle sentencing to occur in the Childrens’ Court, amend the offence of incitement and provide that an offender cannot be concurrently subject to a good behavior order and a parole order.

Crimes Legislation Amendment Bill 2018

This bill will amend a number of criminal laws to improve the operation and efficiency of the criminal justice system. These amendments include, clarification that warrants under the Crimes (Child Sex Offenders) Act 2005 are issued by a magistrate, rather than the Magistrates Court, extending the ability to issue warrants to an associate judge of the Supreme Court and increasing the monetary value of a penalty unit for offences.

Crimes Legislation Amendment Bill 2019

This bill will amend a range of criminal laws to improve the operation and efficiency of the criminal justice system. These amendments will include providing that the sale and consumption of low THC hemp seeds as food will not be subject to criminal offences and clarifying the original policy intent for the definitions of choke, strangle and suffocate in the Crimes Act 1900.

Disability Services Amendment Bill 2018

This bill will amend the Disability Services Act 1991 to provide the Official Visitors for Disability Services with improved access to monitor and investigate the welfare of potentially vulnerable persons in disability accommodation.

Discrimination Amendment Bill 2018

Domestic Animals (Disqualified Keepers Register) Amendment Bill 2019

This bill will amend the Domestic Animals Act 2000 to put mechanisms in place to ensure that a person found to be disqualified of keeping animals is adhering to the conditions of the disqualification.

Domestic Animals (Racing Greyhounds) Amendment Bill 2017

This bill will amend the Domestic Animals Act 2000 by adding provisions that outline the obligations attached to those who own or have day-to-day control of greyhounds that are involved, or are intended to be involved, in greyhound racing outside the ACT. The bill also makes amendments to the Domestic Animals Regulation 2001 by including additional information to be required for racing greyhound registrations, and the information that will be provided on certificates of registration. The bill also proposes amendments to the Animal Welfare Act 1992 to make it an offence to conduct, or facilitate the conduct of, greyhound racing in the ACT.

Drugs of Dependence (Personal Cannabis Use) Amendment Bill 2018

This bill will amend the Drugs of Dependence Act 1989 to allow for the personal use and carrying of cannabis up to a limit of 50 grams. The bill will also allow individuals to grow up to four cannabis plants, excluding artificial crop growing.

Education Amendment Bill 2017

This bill will amend the Education Act 2004 to provide a one step process for home education registration. The bill also proposes that information required to support an application for registration, or renewal, may be prescribed by Regulation. This bill will amend the Education Act 2004 and the Education Regulation 2005 by providing clarity to the roles and responsibilities of people carrying a duty of care to children and young people in schools, and ensuring that the most vulnerable students are protected by implementing a recommendation from the Royal Commission into Institutional Responses to Child Sexual Abuse. The bill will strengthen the Government’s ability to enforce the attendance of non-ACT residents enrolled in ACT schools. The bill also enables parental and local citizen engagement on school boards, where a school does not have a current parent and citizen arrangement.

Education (Child Safety in Schools) Legislation Amendment Bill 2018

This bill will amend the ACT Teacher Quality Institute Act 2010, the Education Act 2004 and the Education Regulation 2005 to clarify the roles and responsibilities of people responsible for children and young people in ACT schools. The bill will strengthen the reporting requirements in the Teacher Quality Institute Act 2010 and ensure that teachers maintain a working with vulnerable people registration in order to teach. Provisions included in the bill will begin the implementation of the Government’s commitments as a consequence of the Royal Commission into Institutional Responses to Child Sexual Abuse.

Electoral Amendment Bill 2018

This bill will amend the Electoral Act 1992 to prohibit property developers and close associates giving gifts to political entities and will place a prohibition on political entities accepting such gifts. The bill also amends the definition of gift and amends the timeframe for reporting of gifts received over the $1 000 threshold.

Electoral Legislation Amendment Bill 2019

This bill will amend the Electoral Act 1992 and the Public Unleased Land Act 2013. The amendments include allowing voters to enrol to vote in an election up to and including on election day, require the full given name and surname of a person and the name of an entity (where electoral matter is published on behalf of an entity) to be shown in an authorisation statement, and allows an authorised person to immediately remove electoral advertising signs from public unleased land, where the signs are not compliant with statutory requirements, without providing prior notice to the owner of the sign.

Electricity Feed-in (Large-scale Renewable Energy Generation) Amendment Bill 2017

This bill will amend the Electricity Feed-in (Large-scale Renewable Energy Generation) Act 2011 and the Electricity Feed-in (Large-scale Renewable Energy Generation) Regulation 2017 to prescribe matters the Minister must consider when confirming an FiT entitlement surrender. The bill will also provide for the Minister to oversee the amount(s) that the ACT electricity distributor passes on to ACT electricity retailers as compensation for the FiT support payments. In addition, the bill will enable the Minister to require the electricity distributor to commission an audit of the FiT support payment information provided by the distributor.

Electricity Feed-in (Large-scale Renewable Energy Generation) Amendment Bill 2019

This bill will amend the Electricity Feed-in (Large-scale Renewable Energy Generation) Act 2011 to disapply certain provisions that would otherwise delay the granting of feed-in tariff (FiT) entitlements to give effect to the outcomes of the renewables Auction 5. The amendments will enable the Minister to grant FiT entitlements to the auction winners immediately, rather than waiting for the day after the sixth sitting day after the relevant capacity release documentation is presented to the Assembly.

Electricity Feed-in (Renewable Energy Premium) Amendment Bill 2020

This bill will amend the Electricity Feed-in (Renewable Energy Premium) Act 2008 to include provisions to allow electricity distributors to pass on reasonable costs of administering the ACT Small and Medium-scale Feed-in Tariff Scheme to eligible entities. The amendments also strengthen the legislative requirements for data collection and record keeping.

Electronic Conveyancing National Law (ACT) Bill 2020

This bill will apply a national law to provide for electronic conveyancing in the Territory and will allow Canberrans to receive the benefit of best practice land titling processes. Electronic conveyancing will also increase protections against fraudulent dealings.

Emergencies Amendment Bill 2018

This bill will amend the Emergencies Act 2004 and a number of other Territory Acts to implement recommendations from the whole of ACT Government review of the effectiveness of the response to the 2019-20 bushfire season. The amendments contained in the bill primarily relate to the appointment of an emergency controller as well as the functions and powers of that position.

Employment and Workplace Safety Legislation Amendment Bill 2020

This bill will amend the Workers Compensation Act 1951 by modernising provisions of the Act that deal with insurer and self-insurer approval to ensure workers can expect a consistent standard of service, regardless of whether their employer has a workers’ compensation insurance policy or is self-insured. The bill will also amend the Work Health and Safety Act 2011 by inserting a new power on exercising a right of entry at a workplace. The Public Sector Management Act 1994 will also be amended by this bill to align it with ACT Public Sector Enterprise Agreements in relation to merit and selection principles. Structure and technical amendments will also be made to the Dangerous Goods (Road Transport) Act 2009.

Energy Efficiency (Cost of Living) Improvement Amendment Bill 2019

This bill will amend the Energy Efficiency (Cost of Living) Improvement Act 2012 to extend and enhance the operation of the Energy Efficiency Improvement Scheme. The amendments include defining the energy savings obligation as an energy metric instead of the current greenhouse gas emissions metric, amending how eligible classes of priority households are determined and allowing the scheme to offer transport activities.

This bill will amend the Evidence (Miscellaneous Provisions) Act 1991 and the Evidence (Miscellaneous Provisions) Regulation 2009. The bill will establish the legislative framework for the use of intermediaries and ground rules hearings in criminal proceedings, which will include requiring intermediaries to be appointed for all child complainants in sexual offence proceedings and all child witnesses in homicide proceedings, subject to some exceptions.

The bill also exempts participants, coaches and officials of biathlon or modern pentathlon from the requirement to obtain a permit for their laser target shooting devices used for the participation in their sport.

Gaming Machine (Cash Facilities) Amendment Bill 2017

This bill will amend the Gaming Machine Act 2004 and the Gaming Machine Regulation 2004 to limit clubs in the Territory to one EFTPOS facility where a person can withdraw cash at the premises. The bill will also limit the amount of cash able to be withdrawn from an EFTPOS facility to $200 and sets rules in relation to staff operating the EFTPOS facility.

Litter Legislation Amendment Bill 2019

This bill will amend a number of Territory laws to provide a strong, contemporary and best-practice legislative framework for preventing, deterring and responding to littering and illegal dumping in the ACT. The amendments include, amending the definition of litter to expressly include dockless bikes, introducing an offence that captures construction material not being appropriately contained onsite which results in those items becoming litter, and introducing a strict liability offence for aggravated littering of specific items listed by regulation, such as syringes and cigarettes.

This bill amends the Long Service Leave (Portable Schemes) Act 2009 to provide better protection for worker entitlements, remove administrative inconsistencies and provide more clarity for employers. The bill strengthens compliance measures by modernising inspector powers, providing interest is payable on any levies that remain unpaid after the due date, and by inserting a new provision to enable the Authority to pursue company directors in situations where a levy remains unpaid and phoenix activity is involved.

Loose-fill Asbestos Legislation Amendment Bill 2020

This bill will amend Territory legislation to give effect to the management of any Mr Fluffy affected properties remaining in the community following the close of the Buyback Program on 30 June 2020. The amendments propose to include: transitional support for homeowners; additional asbestos management plan requirements; development and building approval restrictions; occupancy prohibition; and the potential for compulsory acquisition if required from mid-2025.

Magistrates Court (Infringement Notices) Amendment Bill 2019

This bill will amend the Magistrates Court Act 1930 and the Magistrates Court Regulation 2009. The amendments will provide an opportunity to people who have been issued an infringement notice to either enter into an infringement notice management plan to enable the payment of the penalty by instalment, or participate in an approved community work or social development plan in lieu of paying the penalty, or seek for the penalty to be waived. The amendments will ensure that the payment system for infringement notice offences can take into account the circumstances of people on low incomes or who are otherwise disadvantaged.

Magistrates Court (Retirement Age of Magistrates) Amendment Bill 2018

This bill will amend the Magistrates Court Act 1930 to extend the retirement age of magistrates from 65 years old to 70 years old.

Medicines, Poisons and Therapeutic Goods Amendment Bill 2018

This bill will amend the Medicines, Poisons and Therapeutic Goods Act 2008 and the Medicines, Poisons and Therapeutic Goods Regulation 2008 to establish a regulatory framework that would allow for authorised people to remotely access, use and disclose information on the ACT’s monitored medicines database as a public health and clinical support tool. This bill will also establish administrative functions relating to the use of the database information, and introduce several new offence provisions to limit the bill’s impact on personal privacy.

Mental Health Amendment Bill 2020

This bill will amend the Mental Health Act 2015 by improving the rights of mental health consumers subject to the Act through the inclusion of additional safeguards to apprehension and provides additional clarity about contraventions orders. The bill will also extend the affected persons register and providing a mechanism for the ACT Civil and Administrative Tribunal to consider the views of the affected person and the Victims of Crime Commissioner when orders are being contemplated. Amendments to the Act will also provide the Chief Psychiatrist with a power to issue guidelines that can provide greater detail on complex questions of operationalising the Act.

Monitoring of Places of Detention (Optional Protocol to the Convention Against Torture) Bill 2017

This bill will provide a legal structure for the Territory to meet its obligations for the United Nations Subcommittee on the Prevention of Torture to conduct periodic visits to places of detention under the Optional Protocol to the Convention Against Torture when it is ratified.

Motor Accident Injuries Bill 2019

This bill will implement a model for the new Motor Accident Injuries Scheme, as chosen by the citizens’ jury. It will replace the current at-fault compensation scheme operating under the Road Transport (Third‑Party Insurance) Act 2008 with a new hybrid no-fault common law scheme.

Official Visitor Amendment Bill 2019

This bill will amend the Official Visitor Act 2012 and the five operational Acts of the ACT Official Visitor Scheme (Children and Young People Act 2008, Corrections Management Act 2007, Disability Services Act 1997, Housing Assistance Act 2007 and Mental Health Act 2015). The amendments will give effect to the legislative recommendations from the 2017 Review of the Official Visitor Scheme, including removing restrictions on official visitors visiting other operational areas when required to allow for greater flexibility and coverage.

Prostitution Amendment Bill 2018

This bill will make a number of amendments to the Prostitution Act 1992 to address issues of ongoing stigma, safety issues and discrimination. Public Health Amendment Bill 2020

This bill will amend the Public Health Act 1997 by proposing changes to the compensation arrangements under the Act. The amendments provide that compensation will not be payable to an otherwise eligible person if the loss or damage is suffered as a result of anything done in the exercise of a function under Part 7 of the Act in relation to a COVID-19 declaration, while the declaration was in force. Part 7 of the Act relates to public health emergencies.

Public Health Amendment Bill 2020 (No 2)

This bill will amend the Public Health Act 1997 by inserting provisions to allow the relevant Minister to determine a quarantine fee that may be incurred by a person required to quarantine at a place other than the person’s home because of COVID-19.

Public Health (Emergencies) Amendment Bill 2020

This bill will amend the Public Health Act 1997 to allow an extension, or further extensions, of a declared public health emergency to remain in force for a period of up to 90 days when it relates to a declaration made due to the COVID-19 emergency. The bill will also give the chief health officer and authorised persons certainty as to the lawful exercise of emergency powers, under the Act, and will allow the Government to communicate with certainty about emergency arrangements with more notice to the community.

Public Interest Disclosure Amendment Bill 2020

This bill will amend the Public Interest Disclosure Act 2012 to support a pro-disclosure culture and system that provides clarity to disclosers and disclosure officers and will require all disclosures under the Act to be forwarded to the ACT Integrity Commission. The amendments will also improve the integrity framework, reduce the scope of the Act and remove the overlap with the Integrity Commission Act 2019.

Public Sector Management Amendment Bill 2019

This bill will amend the Public Sector Management Act 1994 to strengthen the existing ACT Public Service employment framework and provide greater alignment within the existing employment framework to ensure that the legislation operates effectively. Rates Amendment Bill 2020

This bill will amend the Rates Act 2004 by lengthening the period used to calculate the average unimproved value of parcels of land in the Territory from three years to five years. The bill will also amend the Act to require the commissioner to redetermine the unimproved value of a parcel of land as soon as practicable after a lease is varied.

Red Tape Reduction Legislation Amendment Bill 2017

This bill will make amendments to a number of Territory laws to reduce red tape. The amendments remove certain administrative burdens for charities and firewood merchants and will decrease the levy charged to small energy utility suppliers. The bill will also introduce a new offence provision for non-compliant licensed agents, removes breed-specific provisions concerning greyhounds and remove certain barriers to those applying for a security employee licence in low risk activities. The bill repeals the Public Bathing Act 1956 and the Environment Protection (ACT Firewood) Code of Practice 1999.

Red Tape Reduction Legislation Amendment Bill 2018

This bill will make amendments to a number of Territory laws to address outdated requirements and reduce red tape by addressing duplication and providing greater clarity for ACT businesses, individuals and community organisations in achieving regulatory outcomes. Residential Tenancies Amendment Bill 2020

This bill will amend the Residential Tenancies Act 1997, the Human Rights Commission Act 2005, the Uncollected Goods Act 1996 and the Residential Tenancies Regulation 1998 to improve protections for occupants by introducing new occupancy principles and by making those principles a mandatory part of every occupancy agreement. The bill will also clarify the difference between an occupancy agreement and a residential tenancy agreement and clarify the application of the occupancy framework to people who reside in residential parks.

The amendments include providing the ACT Revenue Office with the ability to inform parties who have an interest in the property of a defaulting taxpayer, such as mortgagees or credit providers, of the amount of an outstanding tax debt and the existence of a statutory first charge. It also allows for a limited exemption from land tax for private properties rented through a community housing provider.

Road Transport Legislation Amendment Bill 2019

This bill will make a number of amendments to Territory laws to improve road safety and improve the administration and efficiency of the Territory’s road transport legislation. The amendments include introducing automatic disqualification periods for drivers who repeatedly drive while suspended when the original reason for the suspension was non-payment of an infringement notice penalty, non-compliance with an infringement notice management plan, fine default or exceeding the applicable demerit point threshold, and extending the offences of using an unregistered motor vehicle or uninsured motor vehicle to a responsible person who permits or allows a person to use an unregistered or uninsured motor vehicle.

Royal Commission Criminal Justice Legislation Amendment Bill 2020

This bill will make amendments to Territory laws to implement a number of recommendations made by the Royal Commission into Institutional Response to Child Sexual Abuse. The amendments relate to provisions in the Crimes Act 1900 concerning a sexual relationship with a child or young person under special care, the tendency and coincidence evidence provisions in the Evidence Act 2011 and clarify the status of disclosures in the setting of a religious confessional. The bill also proposes further amendments to the Evidence Act 2011 in relation to reporting laws.

Tree Protection Amendment Bill 2017

This bill will amend the Tree Protection Act 2005 to provide for the Conservator of Flora and Fauna to have discretion to deregister a registered tree that has died from natural causes. The bill will also clarify who has access to merits review of certain decisions made by the Conservator of Flora and Fauna.

Unit Titles Legislation Amendment Bill 2019

This bill will amend number of Territory laws to improve the operation of legislation associated to the development, governance and administration of unit plans in the ACT. The bill includes measures to make sure that purchasers of units are informed of the key features of units when entering into a contract of sale and are informed of changes to those details should circumstances change after the signing of the contract. The bill also sets out certain matters that must be included in a “disclosure statement” which is a written statement that must be included in the contract of sale - these requirements set out certain fundamental matters that are considered important and necessary for the buyer to know when considering signing a contract of sale.

Utilities Legislation Amendment Bill 2017

This bill will amend the Utilities Act 2000, the Utilities (Technical Regulation) Act 2014 and the Utilities (Technical Regulation) Regulation 2017 by inserting general regulation-making power into each law to enable classes of services to be removed from the regulatory schemes if certain conditions are met. The bill will also provide for the first use of the exemption power in relation to embedded electricity networks.

Utilities (Streetlight Network) Legislation Amendment Bill 2017

This bill will amend the Electricity Safety Act 1971, the Electricity Safety Regulation 2004 and the Utilities Act 2000 to ensure that the streetlight network is clearly defined and that a clear distinction exists between the streetlight network and electricity distribution network. The bill will also facilitate access to streetlighting assets and clarify the technical standards that apply.

Utilities (Technical Regulation) Amendment Bill 2017

This bill will amend the Utilities (Technical Regulation) Act 2014 to address ongoing issues in relation to the risks caused by trees touching live powerlines in order to increase public safety. The bill will also address important actions under the Strategic Bushfire Management Plan 2014-2019.

Veterinary Practice Bill 2018

This bill will repeal the Veterinary Surgeons Act 2015 and the Veterinary Surgeons Regulations 2015. This bill will improve the efficiency and productivity of the veterinary profession in the ACT by bringing it into harmonisation with NSW legislation and incorporate deemed registration under the national recognition of veterinary registration. This bill will also ensure that the veterinary practice board has the necessary provisions to identify and address malpractice in the sector.

Victims Rights Legislation Amendment Bill 2020

Presented by Mr Rattenbury (Minister for Justice, Consumer Affairs and Road Safety)—2 July 2020

This bill will amend the Victims of Crime Act 1994 by replacing the ‘government principles for the treatment of victims of crime in the administration of justice’ with a Charter of Rights for Victims of Crime. The bill also amends the Victims of Crime Act 1994 and the Human Rights Commission Act 2005 by introducing an accountability framework in the Acts that will provide victims with access to processes for making justice agency complaints and raising victims’ rights concerns where a victim right in the Victims of Crime Charter has not been upheld by an obligated agency.

Waste Management and Resource Recovery Amendment Bill 2017

This bill will amend the Waste Management and Resource Recovery Act 2016 to establish a cost effective container deposit scheme to assist the beverage industry to discharge their responsibilities in relation to dealing with waste and litter generated by beverage product packaging. The bill will also assist the community to reduce litter and promote a cleaner environment.

Waste Management and Resource Recovery Amendment Bill 2018

This bill will amend the Waste Management and Resource Recovery Amendment Act 2017 to provide for an amendment to the commencement provisions in the Act that relate to refund marking requirements. This amendment will allow a period of two years from the commencement of the Act for these requirements to begin.

Water Resources Amendment Bill 2019

This bill will amend the Water Resources Act 2007. The bill will provide identification of the framework of the ACT’s water resource plan which shows how water planning and management takes place in the ACT, and will specify the amount of water available for surface water and groundwater from water management areas up to the sustainable diversion limit.

Workers Compensation Amendment Bill 2017

This bill will amend the Workers Compensation Act 1951 and the Workers Compensation Regulation 2002 to improve access to statutory entitlements for Territory workers and also increase the amount of statutory compensation payable in certain circumstances.

This bill will also mandate consultation with workers and their representatives in the establishment of workgroups, mandate the election and training of Health and Safety Representatives and mandate the election of Health and Safety Committees as well as training for its members.

Work Health and Safety Amendment Bill 2019

Working with Vulnerable People (Background Checking) Amendment Bill 2019

This bill will amend the Working with Vulnerable People (Background Checking) Act 2011 and other legislation. The bill will allow the ACT to implement the commitments under the Intergovernmental Agreement on Nationally Consistent Worker Screening for the National Disability Insurance Scheme. The bill will make amendments consistent with the national agreement on the National Disability Insurance Scheme worker background screening, including improved information sharing, streamlining registration and introduction of disqualifying offences.

Working with Vulnerable People (Background Checking) Amendment Bill 2020

This bill will amend the Working with Vulnerable People (Background Checking) Act 2011 to strengthen safeguards for vulnerable people in the community, particularly children and people with disability. The bill extends the application of disqualifying offences for the National Disability Insurance Scheme (NDIS) workers, refines the classification of offences to align with the NDIS worker screening framework and establishes a process for assessing kinship carers. The bill also gives effect to the National Standards for Working with Children Checks (National Standards) and implements recommendations of the Royal Commission into Institutional Responses to Child Sexual Abuse relating to working with children.

Workplace Legislation Amendment Bill 2018

This bill will amend the Public Sector Management Act 1994 to outline actions that can be taken to recover overpayments from the salary of a Territory employee. The bill also amends the Workplace Privacy Amendment Act 2016 to provide a framework for surveillance in the workplace to ensure compatibility with information privacy laws in the ACT.
